Disclosure, platform policy, and responsible practice

What does a brand actually have to get right, legally and on platform?

10 guides · Last verified September 2, 2026

What this part of the work is

Compliance in this channel is usually treated as a checkbox exercise attached to the end of a campaign, which is precisely when everything it might catch is most expensive to fix. It is better understood as a set of decisions taken at brief stage: what may be claimed, who may be engaged, which categories are permitted where, and how the relationship will be communicated to an audience.

These guides cover disclosure on each major platform and why the mechanics differ by format, commercial email rules for outreach, building a checklist that is a control rather than a document, working with creators under eighteen, operating in regulated categories, and handling creator data responsibly.

Two principles run through all of them. A platform’s own paid-promotion control and a disclosure to the audience are different things doing different jobs. And disclosure does not cure a claim: labelling content as advertising addresses whether the audience knows there is a commercial relationship, and nothing else. These pages are general information, not legal advice, and each says where specialist advice begins.

Where it goes wrong

The failures that recur here

  • 01

Disclosure fails differently on every format

Captions truncate, Stories advance before text can be read, short-form is watched without sound, long-form puts the sponsored segment eight minutes in where a chapter link lands, and a livestream has no beginning at all. A single disclosure instruction issued across a roster will fail somewhere, and the failure is invisible until someone checks the live post on a phone.

  • 02

An advertiser owns the claims made on its behalf

Routing a statement through a creator does not make it sayable, and personal framing is not an exemption: testimonials about efficacy, typical results and financial outcomes are among the most scrutinised statements there are. The workable approach is a substantiated claim library with exact wording and an explicit list of what must not be said.

  • 03

    Public availability is not permission

A published business email is an invitation to relevant contact, not consent to marketing at volume, and creator databases are collections of information about identifiable people who never asked to be in them. Necessity, provenance, correction and retention are the working controls, and inference presented as measurement is the failure that does the most damage.

Questions and answers

Common questions

Is a platform’s paid-partnership label enough?
No. It satisfies the platform’s own policy, and its prominence, duration and placement are the platform’s decision rather than yours. Add clear disclosure inside the content, where the audience seeing the endorsement will actually encounter it.
Does gifting need to be disclosed?
Receiving free product is a material connection, so coverage resulting from it needs to be clear about the relationship. Words such as gifted, collab or ambassador are weak because they do not reliably tell a general audience the content is advertising. Use plain wording, placed where it will be seen.
Who is responsible if a creator gets it wrong?
Both parties have obligations, and an advertiser is generally responsible for claims made on its behalf, which is why briefing and monitoring matter more than contractual indemnities. The practical answer is to make compliance easy to do correctly and to check the live content rather than assume.
